The document, the terms of which are outlined below, is a Public Offer and a Public Agreement. In accordance with Articles 633 and 641 of the Civil Code of Ukraine, the terms of the public offer and the public agreement are the same for all Customers.
According to Part 2 of Article 642 of the Civil Code of Ukraine, making a payment constitutes acceptance (agreement) of this offer, which is equivalent to the conclusion of an agreement on the terms set forth below.
This Public Offer is addressed to all individuals and legal entities who wish to use the service and have the technical ability to access the service.

PUBLIC AGREEMENT (OFFER)
for the provision of information services

GENERAL TERMS
1.1. This Public Agreement (hereinafter referred to as the Offer or Agreement) is an official offer by the individual entrepreneur Maria Koltakova (hereinafter referred to as the Contractor) to provide Information Services to the individual Olga Sydora (hereinafter referred to as the Customer) on the terms set forth below, through the provision of information via text, video, photo, audio lessons/messages — a special form of information transfer aimed at acquiring additional knowledge, skills, and abilities in a particular field of activity by the Customer as a result of the use of special measures determined at their discretion.
1.2. Acceptance (agreement) of this Offer means the full and unconditional acceptance by the Customer of all the terms without any exceptions and/or restrictions and is equivalent, according to Part 2 of Article 642 of the Civil Code of Ukraine (hereinafter referred to as the Civil Code of Ukraine), to the conclusion of a bilateral written agreement on the terms set forth below in this Offer.
1.3. This Public Agreement for the provision of Information Services (Offer) is considered concluded (accepted) from the moment the Customer’s payment is received on the account specified by the Contractor.
1.4. The Contractor and the Customer provide mutual guarantees of their legal capacity and ability necessary to conclude and fulfill this Agreement for the provision of Information Services.

DEFINITIONS AND TERMS
2.1. For the purposes of this Offer, the following terms are used with the meaning defined below:
Offer — the public agreement for the provision of information services.
Information Services — any services of the Contractor, information about the types and cost of which is specified on the Website, on the Instagram social media page, or any other resource where this offer agreement is posted, which provide limited access to the Customer to closed channels for providing educational materials (for example, but not limited to a closed Telegram channel, cloud storage of information) according to the terms of the Offer for participation in training in the format of information services provided by the Contractor for a fee, including multimedia courses, training sessions, marathons (both in recorded and live formats), and related information services such as consultations, through the use of closed-source software or other forms of consulting services. The form and necessity of providing additional information services are determined by the Contractor at their discretion.
Acceptance of the Offer — full and unconditional acceptance of the Offer by making a payment for the chosen Information Service.
Contractor — individual entrepreneur Maria Koltakova, @mascha_koltakova
Customer — individual Olga Sydora, @sydoraspace
Agreement on the provision of information services (hereinafter — Agreement) — the agreement between the Customer and the Contractor for the provision of Information Services, concluded by the acceptance of this Offer.
Confidential Information — any information related to the personal data of course participants (event attendees)/recipients of information services provided by the Contractor, any materials of the courses in original form (audio, video, text files, messages, etc.) provided by the Contractor in fulfillment of this Agreement and any other information whose confidentiality the Customer has been notified of in advance by the Contractor.

SUBJECT OF THE OFFER
3.1. In accordance with the terms of this Offer, the Contractor provides the Customer with Information Services for a fee in video, photo, audio, text formats, and the Customer accepts and pays for these services according to the specified rate.
3.2. The cost of each type of Information Service is determined by the Contractor separately, depending on the chosen type of Information Service, and is specified on the website and/or any other resource where this offer agreement is posted. This Agreement for the provision of Information Services is considered concluded from the moment the payment is received in the account specified by the Contractor.
3.3. Payments under this Agreement can be made in one of the ways offered to the Customer, including by clicking the "Pay" button, which includes the following payment methods:

payment by electronic money;
payment via payment terminals or internet banking;
payment to the Contractor's bank account via bank or acquiring bank;
payment through authorized agents (individuals or legal entities);
other methods by prior agreement with the Contractor.
3.4. The provision of services is carried out subject to prepayment and full payment of the selected rate. The Customer has the option to make payments in installments. The amount of the partially paid amount, including the amount paid as a "reservation," is considered a deposit and serves as a guarantee for the performance of monetary obligations by the Customer. If the Customer refuses to make full payment or to proceed with the training, the deposit is not refunded.
3.5. The payment made by the Customer is non-refundable, except for cases provided by Ukrainian law.
3.6. If the Customer fails to fulfill their payment obligations for the training course within the agreed term, the services specified in this Agreement will not be provided by the Contractor, and it will be considered that the inability to fulfill the Agreement was due to the Customer's fault. In this case, no refunds will be made for the services already paid for.
CONDITIONS OF PROVIDING INFORMATION SERVICES
4.1. After payment is made, the Contractor provides the Customer with limited access to the paid Information Service hosted on a closed service/channel for storing and providing information.
4.2. The term for providing each type of Information Service is specified on the Contractor’s website or any other resource where this offer agreement is posted and/or through which the Contractor’s product is sold.
4.3. The purchase of the educational material is confirmed by the payment made by one of the methods provided by the Agreement. Access is provided automatically or after the Customer sends a photo confirmation of payment to the Contractor.
4.4. If the Customer does not receive access to the Information Service within 1 (one) day from the moment of payment and/or within 1 (one) day before the start of the training, the Customer should contact the Contractor’s support service via Telegram at @mascha_koltakova or notify them by any other available method.
4.5. The Contractor begins to provide the Information Service to the Customer by granting access to educational materials, by connecting to the closed Telegram channel and/or granting access to a closed information storage platform, according to the schedule agreed by the Parties. The Contractor reserves the right to publish educational materials gradually according to the agreed schedule. The Contractor may change the agreed schedule for providing access to the educational material by 2 (two) – 3 (three) days.
4.6. This Offer is valid as an act of service provision. The acceptance of the service is carried out without signing the corresponding act.

RIGHTS AND OBLIGATIONS OF THE CONTRACTOR
5.1. The Contractor acts on their own behalf or jointly with a Partner based on an agreement between them.
5.2. The Contractor agrees to provide the Customer with 24/7 access to the paid text, video, photo, audio materials for the agreed period. The schedule for providing such materials is agreed separately by the Parties.
5.3. The Contractor is responsible for storing and processing the Customer's personal data, ensuring the confidentiality of this data during its processing, and using it exclusively for the quality provision of Information Services to the Customer.
5.4. The Contractor guarantees the provision of full and accurate information about the service to the Customer upon their request.
5.5. The Contractor has the right to suspend the provision of paid services from the moment the term (duration) of their provision expires or to limit the Customer’s access to educational materials if full payment has not been made.
5.6. The Contractor has the right to cancel the Customer's access to materials if it is established that the Customer has disseminated the video and audio materials received from the Contractor to third parties, either for payment or free of charge. The use of materials received as part of Information Services is allowed only for personal use by the Customer.
5.7. The Contractor has the right to unilaterally change the terms of this Offer without prior notice to the Customer, publishing the changes on the Website no later than 5 calendar days after their adoption.
